Ref.: AFLAC Complaint / Disagreement with AFLAC
I am writing to bring a formal complaint against AFLAC where they have unilaterally denied my claim after collecting my premiums.
Initially, AFLAC made attempts to deny my claim on the basis of wrongful enrollment to this policy (I have AFLAC's internal email) which did not work in AFLAC’s favor. Then, I was offered a form on several occasions to get refund of my premiums. Later on, efforts were made to deny my claim by asking 15 years of medical records which again did not suffice. Finally, AFLAC decided to deny my claim on an incorrect recording of date of treatment at AFLAC’s end, despite my continual contesting of this inaccuracy.
AFLAC’s final denial’s basis is that losses began on or before the effective date of the policy which is NOT TRUE. In the AFLAC's letter dated 07/13/16, it was pointed out that my treatment dates were as 07/16/13 and 01/22/14 which are INCORRECT. On several of my correspondences to AFLAC, I have clarified that treatment date was 04/22/15 but I never received an acknowledgement of my letters or denial of my explanation.
On Feb. 22, 2016, I addressed another letter to AFLAC where I requested copies of all documents that I initially signed with AFLAC. No acknowledgement or response from AFLAC. On Feb. 22, 2016, another letter was addressed to AFLAC, I had also requested that my file be examined by the California Department of Insurance Consumer Division. This time also, no acknowledgement or response from AFLAC. All through the process, I wanted to be treated as a customer of AFLAC. And I expected answers and explanations of my questions as I always provided answers to AFLAC's questions. However, it appears to me that this long 14-month process of denial was unilateral and based on inaccurate information and I disagree with the basis of denial of my claim.
To this date, I am still requesting AFLAC for the following:
1. Please provide me in writing the proof of AFLAC's determination basis and unilateral selection of 07/16/13 and 01/22/14 as my treatment dates?
2. Please provide written explanation with respect to my request on 02/22/16 that my file be forwarded and examined by California Department of Insurance Consumer Services Division. No response yet from AFLAC
3. Requesting AFLAC to provide all documents that I initially signed when I enrolled with AFLAC so I can sit down with my counsel.
