If you are having problems with your mortgage servicing agent, please do the following: 1) Do NOT negotiate over the phone, you'll never get the same answer twice and end up paying and paying, if you get a phone call, get the name of the agent, date, and ask for everything in writing 2) Put your complaint in writing, send it by certified mail to the mortgage servicing agent and include the terms " Qualified Written Request" under RESPA. Include your name, address, acct#, your complaint(s), problems a timeline that you expect the problem to be resolved. CC: Consumer Financial Protection Bureau as well as the FCC, BBB and your local State Atty General or State Financial Office that gives the license to practice mortgage servicing (debt collection) in your state. If they do call, make note the time, date, service agent's name, again do NOT discuss your debt over the phone ask for everything in writing. If you want, you can record the conversation on your smart phone, just let the other party know you are recording the call. If you get any doorhangers or other annoyances, keep them and note, the time, date, etc. They will have to remove any excessive fees and if the Consumer Financial Protection Bureau is contacted, they will review what they are doing.
