Transferred servicing Mid-short sale causing foreclosure
We have been negotiating a short sale since mid August. As of October 13th Bank of America has now transferred the loan to Greentree and will no longer help the seller. Greentree claims they will not be servicing the loan until November 1st. It is scheduled to foreclose October 31st. Bank of America refuses to help conclude the short sale prior to that time.

My son and his wife submitted a fully executed contract to the broker for a short sale property in early October. It is now the end of March. The bank is the Bank of Amercia. They were repeatedly told the bank has their contract and it is the only one being considered. The real estate broker never updates them, is difficult to reach, and when they do reach him he tells them one story after another as to why this is taking so long. Two days ago he told them there is a complication with the condo association and that they have taken over the property and are renting it. My son researched legal documents regarding the property, and there is no indication this happened. Also, in driving by the property, he sees it is vacant, not rented. The Bank of America tells them they cannot access information directly from the bank, only from the broker. The broker is giving them a run around, and when they ask if they should give up on the property, he says no. How can they get help investigating what is going on?

Refusing to honor modification decision
I received a packet in January 2011 stating that I had been approved to have my mortgage permanently modified. It detailed the payment schedule for the next 25 years and all I had to do was sign the agreement along with the other documents and return them by January 23, 2011, which I did. I have been making my modified mortgage payments and they have been accepted by Bank of America. Now they are saying that the investors rejected my modification because my ex-wife didn't sign the papers. In the agreement there is a provision that says she doesn't have to sign because her interest was transferred to me via a divorce decree PRIOR to the beginning of the modification application based on MY financial information only. How can this happen?

The lender isn't magically aware of your divorce. You need to inform them...

They are either incompetent or criminal
I went through mediation with BofA and their law firm, Potestivo to secure a home loan modification. I was granted a trial mod with the Home Retention dept. I completed the trial mod exactly as ordered, but was later denied a permanent modification. I was told by my "Negotiator" (Andre) that I was $600 short in income per month to qualify. 3 months ago, when I started the mod my income was right on. My financial situation has not changed since the trial was granted. He said that there were "no guarantees, " and that I was told that my "final modification would 'probably' be the same as my trial - key word probably". But, hey, I could begin another "brand new" trial modification with Making Homes Affordable, and pay a trial payment of $1, 160.00 instead of the $820 payments that had been agreed to in mediation. $340 MORE per month than my previous trial payments. So let me get this straight-I have to make MORE $ to pay LESS, but if I make LESS $ I have to pay MORE. The Home Retention program is based on your NET income, but the MHA program is based on your GROSS income. A third grader could figure out that this doesn't make any sense.
It is a huge scam and we, the taxpayers have given the bank the tools to manipulate this economic crisis for their own benefit. I have been led around like a dog on a leash by this bank. I have faxed them close to 1000 documents over the past 1 1/2 years, duplicates over and over because they claim they don't have them. They are either incompetent or criminal. They are not helping customers with modifications. Look online at the complaints about BofA and home loan modifications.
