Greetings,

Several years ago, your assistance and kindness helped with a difficult situation in dealing with our HOA at Brookestone in Ocoee. For this, my wife and I were extremely grateful to you.

I am once again requesting your help.

For 2 months, we have been trying to get our home painted. The HOA has a list of "approved color plans" and our initial choice was one of the approved. We were turned down due to the HOA claiming that the approved color was too similar to a home 3 house-widths down from us.

We contacted said neighbor who provided evidence of the exact color scheme which was different than what we had chosen. Despite their ruling, we acquiesced to their demand that we pick something differently.

Subsequently, a second color schemeIt was from the "approved" book with a minor adjustment of basic white trim as the original color clashed with our new roof. Please note that the trim color, a minor aspect of the overall color pattern, was basic white.

Again, we were refused.

This is part of a disturbing pattern over the past 7 or 8 years. We have lived here 20 years but during this time frame, a laundry list of biased decisions against us have occurred. Here is a tiny sampling:

Our hill was collapsing and caused $250+ damage to the sprinkler system. For months, the HOA refused to fix it despite our pleas. It was only when YOU became involved did they fix the problem. Please note that we never were reimbursed for the damage.

Our back yard is essentially a small nature preserve. We requested that the trees that I could not reach be trimmed. Our request was turned down 3 times until action was finally taken. Contrast that with our former neighbors whose trees were 40% the size of ours yet had a tree trimming company come to their home upon their first request.

Now this.

There are some 30-40 homes in our neighborhood that are in violation as it relates to paint.

For example, 2 homes that are just around the corner from us are painted the identical color and the identical trim. That is not allowed yet "magically" they received permission to do so.

The house directly across the street from us is painted virtually the identical color as our home (at the time). This is a direct and blatant violation yet was allowed.

It is a clear pattern that my wife and I, for reason(s) unknown, are being singled out. This is unacceptable to put it mildly. We paid the same fees and are entitled to the same rights and protection as anyone else.



The HOA is not there to enforce their own ideals. They are volunteers who represent the will of the homeowners. As such, I would love to meet and hear from one. . . .just one homeowner who would object to us having white trim on our home.

Please note we are talking about basic white trim, not a fluorescent orange or something along these lines.

I ask for your assistance again in helping us deal with this matter. I recognize that there are undoubtedly more pressing issues on your plate but please note that this is our home and our neighborhood.

We just want white trim, the same unobtrusive shade that is on some 80% of homes in the entire state of Florida. We also want to be treated with the same respect and fairness as others.

PS. Please address the matter to the Propertly Management who will forward this to the HOA. It should also be noted that the Proertly Management Company has sided with the HOA despite being contracted to be neutral in all matters.
