We have a second mortgage/line of credit with Cenlar (It originated with Countrywide Loans before they went bankrupt). Our contract is specific - fixed rate. My wife just figured out that Cenlar just raised our interest rates a second time in twelve months despite the contract clause. Moreover, my wife put the loan information into Quickbooks today and discovered that Cenlar changed the way that the interest is calculated. The contract specifies the interest is calculated by the 'average daily balance' method - like used for most credit cards and lines of credit. However, they have been calculating the interest using the 'installment method' - where you get charged the interest for your opening balance for the entire billing period EVEN if you pay early. My wife figures we have been over charged/undercredited by Cenlar an average of $35 a month for over 8 years (over $3000 without considering the effect of compunding interest)! My wife tried several times to figure out monthly statement, contacted them several times regarding this account, but the gloves are off. We are seeking a lawyer who wants to begin a class action suit.
