DAMAC Mishandling of Co Owners Association

Many of us owners of The Piazza, a residential complex built by DAMAC in Lusail City, Doha, Qatar are now enraged on how DAMAC and it’s subsidiary company named LOAMS are still keeping a tight grip on the property’s common area management despite completing the project and handing over the units to its buyers some five years ago. They continue to do the following atrocities up to this day such as:
1. They never had the moral decency to explain us the fine prints of the co owners constitution so biased to their favour that they hastily made us sign at the time of our purchase almost a decade ago;

2. They convened our supposed Co owners association to run our common area upkeep but they never ever gave us the actual control to do so;

3. Negligence of their obligations as specified in the constitution that's already even favourable to them;

4. No Annual General Assembly meeting or special meeting between them and us homeowners has been held for the past 2 years now;

5. With the exception on a very few occasions, our Owners Representative is mostly not being taken seriously by them and is not being made privy to vital operations of the supposed association;

6. Using a lame legal excuse of our association not yet being a legal entity, they refused to give us a directory of all of our other fellow unit owners hence the required 25% members of our association for us to be able to call for an official meeting to make them answer for their wrongdoings was never met and more so most of our fellow owners therefore cannot be notified by our Owners Representative about critical issues that need to be decided on, what their rights and entitlements are, and what their legal options are;

7. DAMAC employees actually operate LOAMS with competence and diligence not acceptable to our expected standards;

8. All service charges, master community charges, reserve funds, individual unit utility charges (water, electricity & district cooling bills) and deficit recovery charges from previous unapproved budgets are still being issued under a single ledger system and even NOT in the name of the Co Owners Association as it should be, but in the name of DAMAC and are being collected by LOAMS with all payments made to DAMAC's bank account only;

9. They do not transparently indicate the rate for our normal service charges and the master community charges separately and still do not separate the billing for individual utility charges from the statement of service charges to the owners which should not be case as the landlords should not be held liable on a various payment attitudes of their tenants towards utility bills;

10. No proper detailed audit report or verifiable justifications of past budgets especially deficits, detailed financial statements and liabilities has ever been made by them to all of us owners;

11. Budgets are not prepared on time and it’s corresponding service charges are already being billed to us even before these are scrutinized by our Owners Representative and worst, are not being subjected to ratification by the majority of owners in any general meeting called for such purpose as mandated by the constitution;

12. Excess security deposits mostly four times the actual requirement paid by us unit owners during the time of hand-over are yet to be returned by them nor has any accounting of such monies has ever been made to us for the past 4 years;
Considering that no constructive dialogue in the many pending issues has ever happened between us owners and DAMAC / LOAMS with them continually being evasive and non-responsive towards our issues at hand, we are now more annoyed than ever.
DAMAC must revise the venal & imperious co owners constitution so biased to their favour and must stop their oppression against us by giving us our freedom as they should have done a long time ago or at least for them to start serving us decently and professionally for them to earn our trust and maybe, just maybe we might retain them or any of their applicable subsidiaries to serve as one of our service providers for as long as they fairly the due process of tenders.
We bought a property in Qatar, and we actually prefer to run our co owners association in a decent & proper manner wherein our rights and interests are best served by a company in Qatar without any foreign control especially from an oppressive foreign entity.
It’s time for DAMAC to either shape up or ship out before we start we entertaining the notion that their continued disservice to us is part of their base country’s economic aggravation against Qatar.
