I have a Default Judgement for $1147.76 against a customer of Flagstar Bank. My original check to him had been deposited by that customer into his account with this bank under its own clear seal and endorsement. When the judgement was unsatisfied, I garnished the bank account at Flagstar Bank, and hand-delivered the original court-provided garnishment forms, with carbon copies included, to the bank branch on 1-25-2021 under acknowledgement of the branch manager. The garnishee bank was required to respond to me and the court within 14 days, i.e, by 02-09-2021. When I did not hear back at all, I called the court ton 02-26-2021o enqire if it had received the response. It had not and so I called the bank and left messages on two different days. I finally heard back from the bank on 03-03-2021. The respondent stated that the formal response had been sent on 01-29-2021. When I told her that niether I nor the court had received any response she tried to blame the USPS. On 03-11-2021 I did receive a typed garnishment form, not the original carbon copy that had been given in triplicate. The court also received that form on the same date and is date-stamped as such. There were several errors of fact apart from the exhorbitant delay so I filed suit in small claims court for the $1147.76. Shortly thereafter I received papers from the Law Firm, HLADIK, ONORATO & FEDERMAN, LLP demanding removal of the proceedings from Small Claims to the General Civil Division. Since then I have received further papers from the Law Firm in that regard. The sheer quantity of papers and communication, and the regular hourly billing by Law firms would suggest that this LLP has probably billed the bank between $4000.00--$6000.00, to simply have the bank avoid the paltry amount indicated above. Use of a sledge hammer to push a thumb tack into cork-board. Even a routine call from the bank would have settled the matter, The Law Firm also should have advised the bank of the inadvisability of engaging their services for such a petty amount.
