I am not one of the managers there, nor am I an employee there. I am however old enough to have been working prior to this current poor economy, and at every job I ever had there were performance requirements to be met, and if I did not like the requirements I was free to leave the job. The only difference now is that there may not be another job to go to. It seems to me that you think that, since the economy is poor, employers should not have performance goals for their employees. What is unfair about the policy if it is applied to the entire waits staff? Nothing at all. If the employees are not meeting all the requirements of the job, then by definition, they are not "good employees."

ok, the point here is not to discuss if their policy is illegal or not, the point here is that the employer should stop treating their waiters like that, this is a type of behaviour they should not promote at all, it hurts the employees feeling and i think is abusive, the employer is taking advantage of the current situation on our tough economy and is sending the wrong message to all others, working in restaurants by itself it is a very difficult job, very stressful, so, i think they have enough with this.
on the other hand, that employer send the wrong message when say that if waiters does not meet or does not like that particular requirement, the doors are open to leave the company...is not professional at all, sometimes is a behaviour promoted by the managers without the knowledge or approval of the real owners...this should be stopped, don't forget that bigger companies like WALMART have been suited before for promoting unfair practices against their employees, or behaviours like the one LA PARRILLA is promoting, so, there is no excuse to do that.
it seems like you are one the managers working there or one of the owners not very happy to hear real comments like this, right? every body knows that finding employees is not a difficult task now in the market, especially considering the current unemployment rate ( decreasing now) but it is very difficult to find very good employees that can do a very good job, being proud of the company they are working for, so, every employer should start taking care of the good and valuable employees, startting for treating them in a better way, not threatening their employees...you know what are talking about it perfectly, i know...

I agreed that the policy itself is not a good one. I merely pointed out that your assertion that it was illegal to have such a policy is incorrect.

as a consumer ( not an employee ) i want to make a complaint against the policy of the mexican restaurant LA PARRILLA, located in acworth, GA 30101 and all the other branchs they have all over the city of atlanta, ga
in this case, i had the chance to talk with one of the employees there while eating, he( she ) was taking care of myself, offering me very good service, and professionalism, i have no doubt about it, however, he (she ) told me that their managers regularly make too much pressure on all the waiters all the time, in order to make the customers to buy deserts after having a dinner or lunch at their facilities, and that if the customers don't buy a desert, managers blame on the waiters for that, using this against the performance and review of all those waiters regardless in they do a very good job taking care of everything else while serving customers.
because of this unfair pressure, it is common that a lot of employees are resigning or being fired if they don't meet that particular requirement which i consider that as a type of Harassment and completely illegal .
this is the type of unacceptable behavior some companies are adopting now a day, as a consequence of the high market competition found everywhere to survive under this tough economy, but in my opinion, this must be stopped, before the complaints are getting bigger and bigger, motivating those victims to start filing a law suite against that particular Mexican restaurant or any other Mexican restaurant acting in a similar way.
