Did not refund money from cancelled membership within 10 days of cancellation notification
My husband and I entered into a membership agreement with Premium Destinations of Ormond Beach, FL on 02/08/14. We decided that it was too expensive because we have encountered unexpected family expenses. I called Premium Destinations on 02/10/14 and spoke with Rusty Randall 3 times that day. I explained why we were cancelling and was told that I had to send a certified letter requesting this in writing. I was also asked to return the membership book. Since we were flying back to Syracuse, NY on 02/10/14, I sent both a letter and the membership book by certified mail to Premium Destinations on 02/11/14 around 1:00 pm which was well within the 3 day period as stated in the Notice of Cancellation part of the Membership agreement. The Membership Agreement stated that: "If you cancel, the club will return, within 10 days of the date of which you give notice of cancellation, a total refund." Rusty Randall knew that we were cancelling. Furthermore, I sent a fax on 02/11/14 to Premium Destinations stating that the certified package containing the cancellation letter and the Membership Book had just been sent from the Post Office. In addition, I called Premium Destinations (on 02/11/14)and spoke with Stephanie to see if the fax had been received, and she verified that it had been received. Needless to say, the office of Premium Destinations was well informed by 02/11/14 of our intent of cancellation, and the actual certified package was received on 02/13/14 as per the signed return receipt.
I called Premium Destinations on 02/24/14 around 7:00 pm and spoke to Stephanie. I told her that it had been over 10 days since the certified package had been received by Premium Destinations, and that my husband and I expected our refund. She told me that she needed to have a supervisor call me. I said that I expected to be contacted the very same evening. Needless to say, I received no such call.
I received an email from Candy Barlow of Premium Destinations stating : "I looked into notes and saw your refund has been done and that it should appear in the next few days. I also saw where Kathy McCarty tried to call back and left a message. However, you can rest assure, that your refund has been done and your membership has been canceled. I apologize on Rusty behalf, he should have explained it takes up to 10 days for a refund to be processed, it does state that on the back of the membership agreement. I hope this helps."
No it did not help, Ms. Barlow because it has been more than 10 days since Premium Destinations was notified and still no refund (as of 03/06/2014).
