Scott McMillan La Mesa, McMillan_Law_Firm, Michelle Volk San Diego Attorney, were sued for malpractice and appears were quick to settle where it was agreed to settle the case early in Brightwell v. McMillan, San Diego Superior Court Case # 37-2016-00013972-CU-PN-CTL. McMillan and settled case for malpractice.
Also in 2016 Scott McMillan sued Nordstrom defended by Haight Bonsteel (LA office), San Diego Superior Court Case # 37-2014-00007604-CU-CR-CTL. Court issued $16,000 discovery sanctions against McMillan in 2016. Although the judgment was reversed, it was due to a settlement, it does not negate the findings by the court nor did the court of appeal find the underlying merits of the sanctions to be without merit.
In February 2003, Scott McMillan was involved in suing Fry's Eletronics who filed a motion entitled, “Motion for Preliminary Injunction and Stay to Prohibit Conflicting and Vexatious Litigation Based on Changed Facts or Alternatively, Motion for Reconsideration of November 22, 2002 Order Denying Motion for Preliminary Injunction/Stay.”… Fry's supported its motion with various documents it lodged in this case that were taken from the Apex case.”..”require that we direct the trial court to grant judgment on the pleadings in favor of Fry's” (Lytwyn v. Fry's Electronics, Inc. (2005) 126 Cal.App.4th 1455, 1464 [25 Cal.Rptr.3d 791].) *
Also, and most interestingly, Scott McMillan is also the Dean of McMillan_Academy_of_Law, which appears to have a single graduate. see attached
The above are some valid concerns I have to share with the public since when hiring an attorney, a consumer needs to know if the attorney is well respected by the judicial system, defense attorney who will often fight a case where the attorney does not have ethics or track record of pursuing meritorious claims, as well as jurors who often do there own research online (although not supposed to) and may decide to find for Scott McMillan and his client and how much.
