Accident assessment- Fraudulent tactics
I got hit by a moving car while i was backing out. Driver of the other car was either texting or looking else where and i have a witness who corroborated my statement.
Driver of the other car hit me hen i was almost out of my parking space and came out of no where as he took a right turn into the drive way where i was backing out. My vehicle rear passenger exhaust area hit his center of the bonnet, showing the angle of impact.
My insurance said the other driver was 80% responsible after assessment and validating with he witness:
Statefarm calls me almost 20 days after the impact and tells me i'm fully responsible. Never gave the witness a call or verified with the Witness.
When asked for clarification on how they determined that I'm responsible, their answer was that they have decided and that is the end of it. I asked for a copy of the voice recording with mt, they declined.
Later Statefarm made false claims that my insurance is lying to me and that they have agreed with them (statefarm). I checked with my insurance and they mentioned they are not aware of such agreement and they stand by their conclusion that the fault is 80% on the other driver.
I'm pushing for a legal action on Statefarm at this time, for Lying, Fraud, protecting their client who was texting/distracted while driving on a parking lot.

Troubling and Arguably Illegal Insurance Company Behavior
My beautiful truck was rear-ended in 2016…and the nightmare still isn’t over in 2018.
State Farm’s “partner” repair facility’s damage estimate: $600.53.
My reputable (Ford) repair facility damage estimate: $2266.33.
Their facility claimed the vehicle had damage from a previous accident, exactly at the point of impact. Doesn’t that seem strange? What accident? The vehicle has never been in any other accident (which I told them)! They also ignored obvious other damage. Hmm. That all seems very suspicious… Is it perhaps to undervalue the claim?
State Farm has refused to pay the difference. State Farm has refused any compromise whatsoever. Is this a limitation on coverage (which is illegal if I choose my own repair facility in TX)? I think it is.
State Farm even tried to settle (for the $600.53 – hahaha) without disclosing in writing that other people have already made claims on the accident, so I’d get a reduced settlement. Were they thinking they could just sneak that in unnoticed? From start to (not yet finished), it’s all seemed very shady and underhanded.
Anyway, my truck’s still busted nearly 500 days after someone else hit it…
