For 12 years we have fought with Sun Communities Westbrook mobile home park over high water bills.
Some of those bills have been over $200...for just one month usage!
We are not the only people complaining, but most people just can't fight the corporate juggernaut.
We're a small company, but have deeper pockets that most of the families who are residents so we have done our best to lead the fight to lower the water bills.
Besides just charging the highest fees for providing the water & sewer service they can, the park is using water meters and remote sending units which are very old and/or defective and that give inaccurate and higher readings of usage. Since some of their fees are based on a % of water used, those fees are also raised. Some of the residents who could not or would not pay the exorbitant fees have been evicted. Since few residents can afford to pay $10,000 or more to move their homes, they end up forfeiting them to the park.
So why can't we do something?
It is difficult.
The parks buy their water from the municipality they're in and re-sell it to the residents. The municipality gets paid by the park and hasn't and real jurisdiction on the water bills the park sends the residents. The parks also own the water meters and remote sending units located on the lots so the local water departments have no responsibility nor right to maintain them.
The parks are quick to tell you that various state rules govern what they can charge and do and what they are not allowed to charge or do regarding water & sewer fees.
But it's largely a sham.
They routinely deny on-site inspections and have successfully blocked most investigations into how they bill, hiding behind confidentiality laws and jurisdictional confusion.
We were able to force them to replace (1) faulty remote sending unit and our bills fell back to more or less "reasonable" levels, but
They will not replace faulty water meters (Some actually have water inside..you can see it through the glass!) and the usage is still inflated from reality.
We believe that the best way to combat them on this issue is to get state laws changed to allow some oversight!
Another way is to spend the money on suing them. If nothing else a rash of suits might help to shine a spotlight on their activities. Of course their response in the past to our legal actions were to bring their own against us; trying to evict us for "rules" violations and to run our legal bills up to levels we couldn't afford.
Political pressure would seem to be a good option, but when we tried our efforts were wasted.
Sun Communities gives a lot of money to our local Democratic party which is the dominant political group in our area so they wouldn't take them on and for whatever reason the Republicans refused to get involved as well.
