General Manger lies to customer about sending her contract to lender

On Friday Nov. 30, 2012 I called the dealership and spoke with a salesman name Nate. He told me to come down after I told him about a car I seen on line stock #v2005 a 2008 Lexus for $16,988. I went to the dealer and they pulled the car up and allowed me to test drive it. They appraised my vehicle and I filled out the application they required they told me they couldn’t trade in my vehicle and that I would have to open a second loan but they would make it affordable for me. I explained I had to pick up my children and they told me they just had to print up the contract and when I get back they will have everything ready to go Nat lied to me and told me the bank approved the car (just to get me to comeback). When I picked up my children and got back to the dealer they told me they could not put me in that car because it had too many miles on it and the bank would not finance it. Instead they had a Saturn outlook pulled up and said they could give me that one instead but never told me the price of the suv. When Nate took me back to the finance guy Jim they changed their story again and told me I could not have that car neither instead they put plates on a 2010 Toyota corolla and told me the lenders were closed and to drive the car for the weekend and come back on Monday Dec.3,2012. That Saturday the car would not start and the dealer had to send someone out to start the car. I drove the car back to the dealer that Monday and asked for Jim and I told him about the idle noise I was hearing and how the brakes were rubbing. I did sign the contract and left the car there for servicing. When I looked over the contract and seen the interest rate was 19% I told Nate I could not afford the car and that I still had my other car payment he told me that was fine just leave the car there and come back on Wednesday when Jim is back and I would just have to sign some cancelation papers (I never took possession of the car or drove it off their car lot after I signed the contract on Monday Dec.3, 2012). When I got back to the dealer that Wednesday under the impression I just had to sign some cancellation papers Jim told me it doesn’t work like that I signed the contract and I cannot change my mind and that he can’t do anything about it that he would have to talk to his boss. They took me to another guy by the name of Lenny (I believe that was his name) and he first told me he would try to help me by getting me into something else and then after talking to the general manager John Rizdy he told me that I signed the contract and that the car was mine because they sent everything to the bank and they can’t stop the process now. This was another lie because I called the lender and they said they never received a contract from the car dealer ship with my name on it and that they have not processed anything because they have no contract. When I got home from work the general manager John Rizdy had someone drop the car off in my drive way. When I called him to try to reason with him he was very rude to me and sarcastic telling me he can’t help customers with buyer’s remorse and that my interest was so high because I have bad credit and he also lied to me again telling me the lender was capital one that’s who they sent my contract to.

I am a single parent with three daughters. I cannot afford to pay two car payments, rent and still provide for my children. I have been working hard on establishing my credit and this has put me in a hard position my children and I could end up homeless and with no food if I’m stuck with two open car loans.
