Breach of Contract/Illegal Repossession
I just got my vehicle back February 3, 2015 after Westlake Financial Services/Wilshire Consumer Credit repossessed it January 24, 2015. I never received of a notice of repossession, reinstatement documents or post repossession information. I had to pay an additional 900.00 to get my car back. I sent 2700.00 via Western Union Friday, January 27, 2015 and when I contacted them I was rudely informed that they still wouldn't release my car until I sent them proof of income, residency, copy of auto insurance and three references, and the representative requested that I fax the documents. I insisted on scanning the information and emailing it. I was finally giving an Email so I emailed the information right away. The rep rudely told me that my car wouldn't be released until Monday. I questioned why and she said they have 24 business hours to release the vehicle. I called Monday to get the status of my car, the payoff amount and a different representative told me there was another note on my account requiring a copy of my driver's license, they couldn't give me a payoff amount and they still wouldn't release my car until they received it a copy of my license. I was so upset. I demanded that once I emailed them my license that they BETTER RELEASE MY CAR BY THE END OF THE BUSINESS DAY MONDAY. I emailed my license in the morning and called the company that repossessed my car around 4:00 PM and she told me the vehicle was released. She said she was ordered to ship my vehicle to Denver the next day that Westlake/Wilshire was getting ready to sale my car. When I got home Monday there was a document stating that if I didn't pay the full amount (2000.00) that my vehicle would be sold by February 6, 2015, the letter was dated January 27, 2015 even though they had accepted my 2700.00 payment via Western Union. I finally got my vehicle back Tuesday, February 3, 2015. Westlake/Wilshire refuses to give me a payoff amount so I can pay them in Full. I only had the loan since December 31, 2014 so I know that I don't owe much, but I can't get a payoff amount to pay them in full and get my car title back. I'm seeking legal assistance and guidance. I WILL NOT STOP UNTIL JUSTICE IS SERVED.
