Respected sir,
For the above subject matter and from the above Citation – Resolution Circulars and according to the order of the honorable supreme court and government resolution and order, Ambuja Cement Ltd. is mining continuously without the permission of any legal /mining department and forest department regarding lease which comes in the boundaries of the forest sanctuary area and R.P.F. area 10 K.M. and this company is not following any legal process and rules and regulation of the forest and For the protection of the National sanctuaries in the National interest
This is highly dangerous for the wild animals residing around the mining areas
Such illegal activities of mining must be stopped at the instant effect very quickly and immediately without wasting time.
Legal and adequate measures should be taken quickly and immediately against the illegal mining near and around the forest area. To bring an on the spot stay order it would be proper and quick to stop the illegal mining to help the protection of wild animals at large.
Respondent : 2(1) (Collector) has done illegal activity – prima facie matter. Ambuja Cement Ltd. Has taken the permission from the Environment Department for the Industrial purpose mining of the Sugala and Jagatiya village mining activity by the permission letter no.J-11015/6/2000-IA II(M) but this company has not taken the permission of the forest Department and the Revenue Department for the mining purpose of the land.
According to Right to information act 2005 they have replied us very clearly that Jagatiya and Sugala village of the Kodinar Tehsil comes in the sanctuaries and R.F.P.F area under the 10 kilometer radios and so they have not at all gave permission to the Ambuja Cement Ltd. to do mining.
The date on which information asked about the mining to the forest Department was 19.2.2016….. to this day from the year 1.2.2002…they, that is the forest Department has not given permission to do mining but this company is mining very boldly and continuously within the radios of 10 kilometers fearlessly within the forest area.

According to the information collected about the forest animals from the forest Range Officer in the outside edge area the lions are seen regularly. He has given the figure that in the Sugala village there are 53 lions and in the Jagatiya village there are almost 32 lions.
Like this way Ambuja Cement Ltd. Company's Sugala and Jagatiya plant comes in the prohibited forest area and that is very clearly and forcefully proved by the government officers in writing that Ambuja Cement Ltd is mining illegally in the prohibited area.
2. Respondent No. 2 (1) is accepting that in the sanctuary area and in the national forest area within the 10 km. radius there is strict prohibition for the mining activity and they accept that they have not given any permission to any company for the mining activity. For this matter and after watching the government letter and resolution and order they have tried to stop the activity of mining within the 10 km. area of the forest.
According to the letter of the Dy forest officer - junagadh letter no. JAMANA/TE/14/BA/5366-9/15-16 dated 21/5/15. It has been reported to the collector shri that babara and Dhara,pur village of the Maliya Tehsil which comes in the range of 10 km is givien to the Ambuja Cenent to do mining of lime stone.This was illegal and it was resolved and stopped immediately and also stopped the stone crusher. This type of report was given by the Forest Department to the Collector Shree.
By this way in the Maliya Tehsil there has the lease which comes in the 10 k.m. area is now stopped …. still however Ambuja Cement Ltd. is Mining continuously which comes in the 10 k.m forest area ,even today it is working and it has never stopped the mining. The responsible officers are accepting that illegally Ambuja Cement is mining continuously at Sugala and Jagatiya within the radios of 10 km. of the forest region. The forest department has not given any type of permission to do mining so far. When they have not given permission by the Department…how could they continue to do the mining? at the above mentioned places .Other mining leases are stopped nowadays due to the order of the government… so we request the most learned and honorable sir to order a stay order quickly and for good to protect the wild animals at Jagatiya and Sugala Village to Ambuja Cement Ltd.
Then how this type of the illegal mining is going on and being allowed…. Other mining lease is stopped now days, so we request to the honorable sir to make the stay order to the illegal mining of the Ambuja Cement Ltd. In the Jagatiya and Sugala village.
3. Respondent no. 2 (3) has not done any report for the stopping of the illegal mining and they have replied in the chief minister SWAGAT program that this is the work of the district development officer to see and handle the problem and the situation of the said matter above, this way they remained away from taking the responsibility and they have avoided to take the responsibility.
Our Presentation: Ambuja Cement Ltd. is mining continuously without the permission of any legal mining department and EVEN NOT BY CONVERTING IT TO non-agricultural LAND (mining activity) which comes in the boundaries of the forest sanctuary area and R.P.F. area 10 K.M. in the Sugala village and Jagatiya village in Kodinar Tehsil.

Authority's Answer to the presenter: To inform you regarding this matter that, for the Ambuja Cement Ltd. In the Sugala and Jagatiya village , in the different survey no. total area comes to 417-35-84 sq. Meter ,for the lime stone mining, lease is given to them from the date 19/07/2002 for 30 years. Mining lease is given to them in private and in the government land. After this Ambuja Cement Ltd, has applied to the forest department on dated 17/05/14 to the forest department for the no objection certificate. Moreover if there has been the mining done in the leased areas before getting the No Objection Certificate then it is the revenue Department to see to it that the rules and regulations are followed VERY STRICTLY by the Ambjua Cement Ltd. And it is for the revenue department to take proper and appropriate action that NO ONE breaks the law of the land. According to the under section 66 of revenue law, the Development Officer is responsible to see and rectify and take action on such law breakers as Ambjua cement Ltd. has done and still doing without fear of any government officers. On this matter we have nothing to say further.
Ambuja Cement Ltd. is mining continuously without the permission of any legal /mining department and not following any legal process and rules and regulation which comes in the boundaries of the forest sanctuary area and R.P.F. area 10 K.M so it is totally illegal mining so it is liable to be stopped immediately at the earliest and action must be taken on such law breaker.
• They have only applied for the N.O.C. but they did not get the N.O.C. Even though they asked for it… they did not get permission so they cannot do mining. Just on the basis of application for NOC they cannot do the mining without a proper positive reply to their application for permission to start the mining on the leased land.

• The concerned officers did not inform or inquire even today about the illegal mining as per the revenue law. In this way even the geological department has not done any REAL WORK AND RIGHT REPORT of the illegal mining this may be due to the receiving of heavy corruption they get from them so in their report they make the illegal mining legal to make them do mining to please them and to receive installment time to time, whatever it may be

• They are not working according to their responsibility but they are working against the public interest and doing illegal mining continuously that would come to the notice and it can be recorded if the concerned authorities go for a surprise raid. So we humbly request to the honorable authority to inquire positively and stop the illegal mining at the earliest time possible.

4. In the chief minister's online complain redresser (SWAGAT) programme and in question No: 6 dated 26/05/2016 we the respondent were present there. This programmers were worked in the presence of the District Development Officer–Gir Somanath and in that geologist were also present there at the chief minister's online complain redresser (SWAGAT) programme and they discussed about the above matter and at that time D.D.O. has orally ordered to the geologist to stop the illegal mining activity and to stop the love letter affair with the company ... And ordered them to stop the illegal mining and report to the office within 15 days' time limit.

They also informed that non agricultural mining activity is concerned… is the responsibility of the geological department and it is they who have to stop such illegal mining ….this illegal Mining's report is not made by the geological Department even to this day to inform about it to the revenue department so that the revenue Department can act accordingly to stop such Illegal mining. It was very forcefully brought to their notice that they cannot escape from their responsibility, this type of order they had given to the geological department. We have demanded the presiding of this matter personally so they have replied negatively that there is no signature of the collector on its ruling so we cannot give the proceeding of this matter of this program and also they have not given any stay order on the illegal mining of the Ambuja Cement Ltd.
1. Respondent No ; 2 is helping the rich and political people continuously by creating different type of rules and regulation and letters and they are threatening the small people by sawing the law.

2. Due to the irresponsibility and wrong meaning of the lease mining renewal and to continue the lease mining they have not taken up the consideration or taken the decision to do the renewal application for mining. Even though the renewal has not been done….the mining is going on progressively. .so this mining has to be stopped by all means.. but Ambuja Cement Ltd. is continuing its mining illegally without a bit of fear…very boldly.
7. According to the change in mining rules they have to stop now the illegal permitted lease given earlier because they have not fulfilled the rules which are changed now and we have applied for that even though responsible officers have not done their duty honestly and sincerely so we are here with this application to bring to your notice to study and to give a quick and immediate response and action to be taken to the illegal mining of the ambuja cement ltd.
8 Comparatively this case is liable for the stay order because in other parts of the state there has been a stay to stop the mining activity within the 10 k.m. area of the forest. Almost all other mining stopped in the state but how come this Ambuja Cement Ltd. Is doing illegal mining which is in the 10 k.m. area of the Gir forest without any ones fear. Law is same for everyone it has not to be changed for Ambuja Cement or for any other company. To give the stay order and to stop illegal mining of the Ambuja Cement Ltd. is comparatively in the favor of justice at large.
9. D.F.O in their letter dated : 14-07-2016 instructed the geologist of Gir Somnath to make a survey of those people who does the mining within the radius of 10 Km of the forest area, after their survey they in person went to the mining area of small mining lease holders and threatened them without mercy to windup everything and go back not to be seen here again but it is really a pity that small people have to suffer and face difficulties to earn their bread In the hands of such corrupted government officers. At the same time Ambuja Cements too were doing the mining within the radius of 10 Km of forest area at two places of Kodinar tehsil that is Sugala and Jagatiya Village where wild animals in large numbers often visit these two places as mentioned above. According to the forest ranger, they have not done anything to stop the illegal mining of Ambuja Cement Ltd. as they get fat installment time to time. There is no one in our country to monitor to such corrupted officers from doing illegal work.

10. According to CPC Section 80(c) we have informed in writing Dtd : 23-09-2016 to the collector and chief secretory of gujarat government to take legal action and to stop the illegal mining of Ambuja cement at Sugala and Jagatiya village within the radius of 10Km forest area. They have not done anything to stop it nor have they taken any pain to visit these areas in person to study and examine the illegal work of Ambuja Cement which bring danger to wild animals and environment. we don’t have any reason why they have not taken action on such illegal activity may be they too get fat installment.
11. I hereby bag your honors to pay attention to the situation of the case and to give priority to my matter to get it directed in the favor of wild animals and for a fresh and pure environment for all of us to live a healthy life.
12. Our humble request to you is as given below:
1. To bring a stay order of the Ambuja Cement Ltd, In the Sugala and Jagatiya village of their mining within the 10 Km radius of the forest.
2. To take the legal steps against the irresponsible officers who have done work by way of taking corruption and becoming irresponsible to their duty.

3. To count the illegal mining of the Ambuja Cement Ltd, and to take legal action against them by appointing the court commissioner for an inquiry and action.

4. To grant all our humble request in the interest of the public.

ગુજરાત સરકારશ્રીના જવાબદાર અધિકારીઓની ભ્રષ્ટ-નીતીરીતીને કારણે લોકોના સરકારમાં અટવાયેલ વહીવટી પ્રશ્નો સહના વિશાળ લોકહિત વિરૂધ્ધ ચાલતી પ્રવૃતિઓના નિકાલ માટે માનનીય મુખ્યમંત્રીશ્રીના નામે ફરીયાદ નિવારણ (સ્વાગત) કાર્યક્રમ ચલાવવામાં આવે છે અને આ કાર્યક્રમને ખોટી રીતે સફળ બતાવવા માત્ર સુચનાઓ આપી પ્રશ્ન બંધ કરવામાં આવે છે વાસ્તવમાં સુચનાની કોઈ અમલવારી થતી નથી પ્રશ્ન ત્યાનો ત્યાજ રહે છે ત્યારે અમોએ વારંવાર જીલ્લા સ્વાગત કાર્યક્રમમાં રજુઆતો કરેલ છે અને અમારા પ્રશ્નોને 'હકારાત્મક નિકાલ' ના નામે અંતીત કરી દેવામાં આવેલ પ્રશ્ન સબંધે રાજય સ્વાગત કાર્યક્રમમાં રજુઆત છેકે...,

(૧) અમો અરજદાર, શ્રી યુવા બેરોજગાર હિત રક્ષાક સમિતિ ના પ્રમુખ દરજજે., રાષ્ટ્રીય સંપતિની ચાલતી અધિકારીઓની મીલી ભગતથી ઉધોગગૃહોના ફાયદામાં કાયદા-નિયમો વિરૂધ્ધ ચાલતી લૂટ સબંધેની આધાર પુરાવાઓ સાથેની મા.મુખ્યમંત્રી ફરીયાદ નિવારણ કાર્યક્રમ સહ અનેક વખત લેખીત મોૈખીક રજુઆતો કરવામાં આવેલ છે તેમ છતા ગેરકાયદેસર રીતે સતત ચાલી રહેલ અંબુજા સિમેન્ટ લીના માઈનીંગ સામે કોઈ કાર્યવાહી કરવામાં આવેલ નથી.... માત્ર લેખીતમાં સુચનાઓ અને સુચનાઓનુ કોઈ પલન નહી કરવાની ભ્રષ્ટાચારની રકમ મેળવી મોૈખીક સુચના.., અમારી ફરીયાદોને ભ્રષ્ટ અધિકારીઓને ભ્રષ્ટાચારની રકમ મેળવવા માટેનુ સાધન બનાવી લીધેલ છે.

(ર) રાજય સ્વાગત કાર્યક્રમમાં તારીખ : ૩૦/૦૭/ર૦૧પ થી ભુસ્તરશાસ્ત્રીશ્રી-જુનાગઢ / ઈંચા-ગીર સોમનાથ વિરૂધ્ધ આધાર પુરાવાઓ સાથે તેઓ તારીખ : ૩૧/૦૭/ર૦૧પ ના રોજ નિવૃત થનાર હોય તેમના નિવૃતિ લાભો અટકાવી તાત્કાલીક ખાતાકીય તપાસ સહ કાનુની પગલાઓ લેવા રજુઆત કરેલ હતી, અને તેની નકલ શ્યુમોટો કાર્યવાહી અથર્ે સક્ષામ ઓથોરીટીને ઈ-મેઈલ / પોસ્ટથી મોકલી આપેલ હતી.

આમ સરકારી તંત્ર ભ્રષ્ટાચાર અને ગેરરીતી અટકાવવા ગંભીર નથી, ખુલ્લેઆમ મુખ્યમંત્રીશ્રીના રાજય સ્વાગત કાર્યક્રમની રજુઆત છતા ઉધોગ ગૃહોની ઉધાડી રાષ્ટ્રીય સંપતીની લૂટ સામે મોટી હપ્તાની (ભ્રષ્ટાચારની) રકમ ઉપરથી નીચે સુધીનાને પહોચતી હોય કોઈ કાર્યવાહી કરેલ નથી કે કરે તેમ નથી.

: તત્કાલીન ભુસ્તરશાસ્ત્રીશ્રી સામે જીલ્લા સમાહતર્ા તરફથી ખાનગી રાહે સરકારશ્રીમાં અહેવાલ મોકલવામાં આવેલ છે.
: વડનગર-પેઢાવાડા ગામોમા ગેરકાયદેસર ખનન અંગેની તપાસ ચાલુ છે.
: ફરીયાદ ઘણા લાંબા સમયથી કરવામાં આવેલ હોય તે અન્વયે વધુ વિલંબટાળી તાત્કાલીક ધોરણે પગલા લેવા સુચના આપવામાં આવી.
: દિન : ૧પ માં સ્થળતપાસ પુર્ણ કરવા અને અરજદારશ્રીને સાથે રાખી રોજકામ કરવા સુચના આપી પ્રશ્ન અંતીત.
માત્ર સુચનાઓ આપવામાં આવેલ છે કોઈ કાર્યવાહી કરવામાં આવેલ નથી, પ્રશ્ન હજુ ત્યાને ત્યાજ છે, ત્યારે પ્રશ્ન અંતીત... હકારાત્મક નિકાલ નો શો અર્થ.
ઓન-લાઈન સુચના પછી પણ કોઈ કાર્યવાહી નહી થતા રૂબરૂ રજુઆતો ના અંતે..., તા : ર૧/૦૪/ર૦૧૬ પત્ર નં : પીઆરઓ/સ્વાગત/વશી/ર૬૪/૦૩/ર૦૧૬ થી અહેવાલ રજુ કરી અરજદારને જાણ કરવા લખવામાં આવેલ... આજ સુધી અહેવાલ અન્વયે કોઈ જાણ કરવામાં આવેલ નથી.

(૪) સંસ્થા દ્રવારા કોડીનાર તાલુકાના જગતીયા-સુગાળા ગામો જંગલ વિસ્તારની ૧૦ કીમીની ત્રીજયામાં આવતા હોય અને ઈકો સેન્સીટીવ ઝોન તરીકે જાહેર થતા આ વિસ્તારમાં આવેલ અંબુજા સિમેન્ટ લી ની ચાલતી માઈનીંગ લીઝો ગેરકાયદેસર રીતે કાયદા-નિયમો વિરૂધ્ધ સતત ચાલુ હોવા બાબતે ની મા. મુખ્યમંત્રીશ્રી ફરીયાદ નિવારણ કાર્યક્રમમાં તારીખ : ૪-૪-ર૦૧૬ થી આધાર પુરાવાઓ સાથેની ફરીયાદ રૂબરૂ દાખલ કરેલ હતી.
જીલ્લા સ્વાગત કાર્યક્રમ ના પ્રશ્ન નં : ૬ / મે-ર૦૧૬ થી સમાવવામાં આવેલ. .... હકારાત્મક નિકાલ.
પ્રોસીડીંગ : ભુસ્તરશાસ્ત્રીશ્રી-ગીરસોમનાથ ના જણાવ્યા અનુસાર બીનખેતી કયર્ા વગર લીઝ વિસ્તારમાં ખનન બાબતે મહેસુલી કાયદાની કલમ - ૬૬ હેઠળ જીલ્લા વિકાસ અધિકારીશ્રી ગીર સોમનાથ દ્રવારા કાર્યવાહી કરવાની થાય છે.

મા. અધ્યક્ષાશ્રીના જણાવ્યા મુજબ હાઈકોર્ટના નિદર્ેશ અનુસાર ભુસ્તરશાસ્ત્રીશ્રી એ ગેરકાયદેસર માઈનીંગ લીઝ બંધ કરવા માટે પગલા લેવાના થતા હોય આગામી દિન : ૧પ માં સદરહુ ગેરકાયદેસર માઈનીંગ અટકાવવા સુચના આપી........ પ્રશ્ન અંતીત કરવામાં આવ્યો.

(પ) સંસ્થાની રજુઆતો અને જીલ્લા સ્વાગત કાર્યક્રમના પ્રોસીડીંગ છતા પ્રશ્ન સબંધે જવાબદાર અધિકારીશ્રીઓ દ્રવારા કોઈ કાર્યવાહી ન કરવામાં આવતા સદર પ્રશ્નો બાબતે તારીખ : ૦૮/૦૯/ર૦૧૬ થી પ્રશ્ન સમીક્ષાા થવા સ્વાગત કાર્યક્રમમાં રજુઆત કરવામાં આવેલ જે રજુઆતને ધ્યાને લેવામાં આવેલ નહી કે કોઈ જવાબી કાર્યવાહી સુધા કરવામાં આવેલ નથી.

(૬) કાર્યક્રમમા સુચનાઓ કરી પ્રશ્ન અંતીત કરવામાં આવેલ હોય તે પ્રશ્ન સબંધે સમીક્ષાા થવા લખવા છતા કોઈ કાર્યવાહી જવાબદાર અધિકારીઓ દ્રવારા નહી કરતા ફરી જીલ્લા સ્વાગત કાર્યક્રમમાં તારીખ : ૪/૧૦/૧૬ થી લખેલ હતુ જે રજુઆતને પણ ધ્યાને લેવામાં આવેલ નથી અને બેરોકટોક ગેરકાયદેસર ખનન પ્રવૃતિ તંત્રની મીઠી નજર નીચે સતત ચાલુજ છે..... પ્રશ્નો અંતીત થયેલ છે ... હકારાત્મક નિકાલ બતાવવામાં આવેલ છે..

(૭) કાયદા-નિયમો-પરીપત્રો-ઠરાવો-હુકમોના ખોટા અર્ધધટનો કરી ખુલ્લેઆમ ભ્રષ્ટાચાર અને ગેરરીતી આચરી કંપનીના ફાયદામાં ગેરકાયદેસર ખનન કામગીરી ચલાવવા સબંધે અગ્ર સચિવશ્રી કાયદા વિભાગને તારીખ : ૦૩/૧૧/ર૦૧ર થી લખવા છતા કોઈ કાર્યવાહી કરેલ નથી.

(૮) ખુલ્લેઆમ ભ્રષ્ટાચાર આચરનાર કલેકટરશ્રીની પુન: નિયુકિત બાબતે સચિવશ્રી (પર્સનલ) સામાન્ય વહીવટ વિભાગ - ગાંધીનગર ને તારીખ : ૩૦/૭/ર૦૧૪ થી આધાર પુરાવાઓ સાથેની રજુઆત પછી પણ કોઈ કાર્યવાહી કરવામાં આવેલ નથી.

(૯) સંસ્થા દ્રવારા માનનીય મુખ્યમંત્રીશ્રીના જીલ્લા કાર્યક્રમ સહ માનનીય મુખ્યમંત્રીશ્રી કાયર્ાલય અને સબંધીત વિભાગના સચિવશ્રીઓ / કમિશ્નરશ્રીઓને રજુઆતો કરેલ હતી અને તેઓશ્રીએ પત્રો લખી ફોમર્ાલીટી પુરી કરેલ છે, કોઈ નકકર કાર્યવાહી કરેલ નથી કે કરે તેમ નથી.., રજુઆતના કામે જે પત્રો લખેલ છે તે..,

આમ ઉચ્ચ કક્ષાાએની રજુઆતોમાં માત્રને માત્ર લખવા ખાતર પત્રો લખવામાં આવેલ છે કોઈ કાર્યવાહી કરેલ નથી આમ સરકારી મસીનરીનો દુર ઉપયોગ કરી બેફામ ભ્રષ્ટાચાર અને ગેરરીતી આચરવામાં આવતી હોવાનુ સરકારશ્રીની જાણમાં મુકવા છતા કોઈ કાર્યવાહી જવાબદારો દ્રવારા કરવામાં આવતી નહોય આ બાબત રાષ્ટ્ર હિત સાથે જોડાયેલ હોય ગંભીરતાથી લેવા અમારી રજુઆત સહ નમ્ર માંગણી છેકે...,

(અ) વાસ્તવીક હકીકતો રેકર્ડ ઉપર સ્િવકારવા છતા ગેરકાયદેસર ચાલતી પ્રવૃતિઓ સામે કાર્યવાહી નહી કરનાર જવાબદારો વિરૂધ્ધ સખ્ત કાર્યવાહી થવા.
(બ) સરકારશ્રીના જવાબદાર અધિકારીઓ દ્રવારા ગેરકાયદેસરની પ્રવૃતિઓ સતત ચાલવા દઈ આચરેલ ભ્રષ્ટાચાર અને ગેરરીતી બાબતે ગુન્હો દાખલ કરી કાર્યવાહી થવા.
(ક) તાત્કાલીક અસરથી ગેરકાયદેસરની ખનન પ્રવૃતિ બંધ કરાવી ખનન કરનાર કંપની વિરૂધ્ધ ફોજદારી ગુન્હો દાખલ કરી રાષ્ટ્રીય સંપતીને કરેલ નુકશાન વસુલાત કાર્યવાહી કરવા.
(ડ) માનનીય મુખ્યમંત્રીશ્રીના નામે ચાલતા સ્વાગત કાર્યક્રમની ગરીમા જળવાઈ રહે અને લોકોના પ્રશ્નોનુ ખરી રીતે સમાધાન થાય તે બાબતને ધ્યાને લઈ કાર્યક્રમની ખાસ સમીક્ષાા થવા.
(ઈ) રાષ્ટ્ર હિતમાં કરવાની થતી તમામ કાર્યવાહી થવા મે. થશે.
