Crispen Mapungwana vs Spartan Group: Case No. 604/1920

Good Day,

Reference is made to the above case.

Background:
I was employed by Spartan Group from July 2018 to January 2019. During my employment I was contributing UIF. On termination I went to the Department of Labour in Randburg to claim my UIF. However my employer, Spartan Group, failed to provide the UI. 19 Form, Salary Schedule and my December 2018 and January 2019 payslips as per requirement. The Department of Labour (Randburg) tried in vein to get these documents from Spartan Group despite assurances from Mr. Tsepo Mamabolo the Chief Executive Officer of Spartan Group that he will avail the required documents, until the Department of Labour (Randburg) referred the matter to the Department of Labour (Malboro) for assistance in July 2019.

I did a follow up with the Department of Labour (Malboro) in August 2019 and was referred to Pauline Masie as the inspector of the case. Following my follow up with Pauline, she told me that the address I gave her was wrong and I gave her the employer's current address. Following a second follow up with Pauline in October 2019, she told me that she could not gain access to the new address and would refer the case to the audit department for assistance. On 16th January I visited Pauline in her office in Malboro and she gave me the same response she gave me in October last year. Please find attached the response she gave me. In the attached email she said once the case is sent to UI audit before end of business the following day she was going to provide me with the contact details of the person who will deal with the case. To date I have not heard anything from Pauline.

Pauline does not give me feedback on this case and I have to phone her using other people's numbers because she does not pick any calls from me. She also does not respond to my emails or WhatsApp. This case has taken so long to be resolved and meanwhile I am not employed and I desperately need to be paid my UIF as per law. I am sure the Department of Labour can easily find the domicilia of Spartan Group considering that all construction companies are registered with the Department.

I now request your good office to assist me in this case so that I can start receiving my UIF funds in the earliest possible time especially considering that I am not employed and we are in January I have to pay for school fees and other needs.

I am waiting to hear from you in the earliest possible time.

To whom it may concern

I have been unemployed from December 2019. For someone going through the process of applying for uif is something rather new and scary. I would like to complain about the lack of service and efficiency that department of labour has in randburg . You hear the stories about how lazy or the workers dont really care about the client. Not having an income especially at the beginning of the year is already so stressful but to be told every single time I am there that the system is offline and to think the money that myself and the rest of the people have borrowed to get just to turned away once again. I was left in tears today as this is my 4th time to be turned away after sitting for 5 to 6 hours not having a single thing to eat only to be told when i am next to be assisted that the system is down and you need to com3 back again tomorrow and stand in the long quire once again. Something needs to be done. Why are people not informed before hand or when we enter through those doors. Why do they make us for hours only to be told they cant help us.

maternity benefits

Hi

I gave birth in May 2019 and i have submitted my application for maternity benefit claim on the 22nd of august 2019. I received no feedback from labour department and no notice of claim rejection. i went back to the labour centre in randburg on the 30th of October 2019 and was told that my claim was rejected because my ui 2.7 was nt there when all my documents have been there. i then resubmitted my claim. up until today i am not receiving any information on the status of my claim i went to the labour center again yesterday and was told that they are not able to assist i need to phone uif offices in PTA. PTA uif offices told me to go to randburg labour department

RE: Final payment after resigning from Performance Precision Engineering / Flexi Power in Randfontein, Aureus end of October 2019.

I resigned and worked my month notice with the company and received only some of my final payment from the company. I have been following up with Ms Corneli Geldenhuys on my difference on the payment and everytime she had a new story to not paying me out my final payment. At the moment I am situated in Pta and can't get transport back to Randfontein due to no finances available due to her not paying me my final payment. I have been requesting my payslips also as due to other staff also requesting payslips since I started working there in March 2019.

If I am correct according to law she was suppose to give our payslips before paying our pay.
She always paid us late our pay
And she did not pay me all my owing money after my last day of work.

Staff at the company is very unhappy also for not getting their payslips and have been complaining.

UNPAID ALLOWANCE

I AM THANDEKA DIKGATLI MOSIANE CURRENTLY LIVING IN KROONSTAD AND WAS ON A SKILLS PROGRAMME UNDER DEPARTMENT OF LABOUR FROM THE 17TH SEPTEMBER 2019 TO 30 OCTOBER 2019. THE REASON FOR MY COMPLAINT IS THAT THE PROGRAMME WAS SUPPOSED TO TAKE 4 MONTHS, FUNDED BY DEPARTMENT OF LABOUR AND UIF IN RELATIONSHIP WITH FDC. WE HAVE SINCE WORKED WITH ABOUT 100 OTHER PEOPLE IN KROONSTAD AND BLOEMFONTEIN BUT HAVE NOT GOT PAID OUR ALLOWANCES OF R50 PER DAY. I WILL REALLY APPRECIATE TO HAVE MY MATTER TAKEN INTO ACCOUNT BECAUSE WE ARE STILL AWAITING TO BE CALLED FOR PRACTICALS CONCERNING THE PROGRAMME.

ALLOWANCE: R50
WE ONLY DID THE THEORY PART OF THE PROGRAMME OFFERED BY TTBISA.
WE REALLY FEEL FAILED BY THE DEPARTMENT OF LABOUR SINCE IT IS THE MOST TRUSTED DEPARTMENT THAT CARES FOR PEOPLE AND PROTECTS THEIR RIGHTS. I WILL APPRECIATE TO HAVE MY MATTER ADDRESSED AND GET MY LLOWANCE. IT IS THE ONLY THING I AM CONCERNED OF NOW.

Mzukisi Zolwana is dealing with this case .I have sorted out the new id plus banking details that confirming this new surname. But still didn receive nothing or an update now its End November 2019 . investigations officer Nkosinathi Nangu is not taking his Job seriously treating clients like they are idiotic and uneducated, when asking for feed back he answers his phone places it aside and has a conversation with other people, I tried calling again and a lady answered but kept quiet when I asked to speak to the officer, kindly advise what the way forward would be as I applied for my UIF in June 2 2019 yet its November with no feed back

2010 Toyota Tundra illgaly Repossession

In 2010 I bought a new Toyota Tundra with a $17,000.00 down payment and a loan from Wells Fargo for $18,000.00 and payments of $325.47 a month. The reason they took my truck the first time in 6/7/13 is because Wells Fargo moved back a payment back from 3/1/13 to 2/28/13 February had a payment on 2/6/13 so now March has no payment but my bank statement shows it on 3/1/13. The repossession report was dated 6/10/13 when mailed the truck was token from my gated driveway in 6/7/13 days before they notified
me corner stone recovery made a key for my truck, removed the back seat, and took all my tools I had in my truck this happened twice all so in October 30/ 2013 because I sent two payments plus for $691.83 on 10/4/13 they sent back that payment on 10/7/13
again on 10/10 I sent the same payment back to Wells Fargo then they sent it back to bank of America where I bank. I have all my recites of every payment I made I had my truck for 39 months and made 41 payments so why did they take my truck?

No assistance with claiming UIF

Good day

I was retrenched in September this year and put a claim through for UIF which was declined with no reason provided. I then lodged and appeal and someone from head quarters is asking me for information from part time employment I had ten years ago while I was still studying my degree. Firstly it is widely publicized that the department of labour had a system change and all the information did not pull through so now the department is making it my problem. Secondly how can you just reject my UIF claim without a reason I have filed all my taxes for every single employment and I’ve highlighted this to the guy who got back to me from head quarters. I am a qualified professional and I’ve been working for the past 8 years I’ve always paid my Paye and Taxes and and now I can’t even get any assistance from government when I’m unemployed can I please get urgent assistance because I’ve followed up numerous times on email with no luck I can’t understand why it’s a struggle when I’m entitled to UIF

Poor services

My name is Suzan Makhubela I have been retrenched last year, I went to UIF offices in Louis Trichardt to apply for UIF on the 6 November 2018 even today I am not getting assistance they would just give me a return date when I go back they would just turn me away without even checking for progress its almost a year with no assistance. I am currently unemployed I can't afford a lawyer to handle this matter on my behalf I am now pleading with the department to please intervene and actually get some assistance. even today I went and like any other day they told me that I should bring my documents without the person checking for anything on the system, I even tried using *143# and it once said my application has been approved. today when I check on the same number *143# it says I am not registered on the system so I don't know anymore what to do. my contact number is 0720871025.

Bad service

have applied for maternity benefits since May even today my application has not been approved, I make follow ups almost everyday and I always get different stories from consultants. When I try to send an email I will be getting a response after 2 months, I have been told the I need to submit the birth certificate because the one the have was no clear but still after submitting the birth certificate nothing has been done I even went to the office just to submit the birth certificate hoping that maybe it's gonna be different but still the document not uploaded and my claim still hanging, I really need assistance on this I don't know how to go about this matter because emails are inserted, calls give me different stories everytime my I'd number is 8008030668086.

2016 Maternity claim not paid

Hi,

I have been on maternity leave April - August 2016. I submitted all the required documentation and after the claim has not been successfully processed, I visited the Kempton branch 4 times, each time submitting different documentation (which was all previously submitted). Every time I have to wait a month before I can follow up. I emailed all the email addresses listed without any response. I was on hold with the call center for hours and hours. Every time a different person assist saying something else.

It is now August 2019 and still I have not received ANY payment for my maternity claim. Please can someone competent assist me in this regard. It is ridiculous to keep making UIF payments when I know my claim for 2 over years have not been processed.

Unable to submit UIF contributions

Since the dept of labour decided to 'upgrade' their website - it is impossible to submit our contributions. First we were locked/blocked out of the site - and then after literally days of trying to get anyone to answer a phone call - we got a new password. (The average time before your call maybe will be answered is 50min -1h30 - whereafter the line simply cuts out)
And now we still cannot submit our contributions as all employee information is completely incorrect. Workers who resigned,left or died years back now all of a sudden appear on our list - and it is simply impossible to rectify this. The site also says that contributions were not paid for some employees -while I sit with the proof of payment in front of me!!!
I am helpless to to my payments without the help of this department - and they do not answer there phones. And if - after hours of wasting time to get hold of them - you get lucky - and somebody answers they are extremely rude or pretend that they cannot hear you and then they just cut your call.
O yes- and every day there is a period of time where they simply "do not take calls"(on 0860 345 464) Like today- from 9h15 - 10h15.
We have send endless e-mails to the contact center - nobody bothers to contact you - or answer you.
Is anyone out there listening??? We are trying to do the right thing - obey the law - like we have always done - with no problem. Until you decided to upgrade your website.

payment of my compensation fund claim

hi , I submitted a claim way back in 1995. I submitted the necessary documents . Maternity Leave UIF

No support available for contibutions

I am an employer who paid my contributions diligently. After the website upgrade it is no more possible to pay the monthly contribution. I have paid via EFT, for 3 months in advance when the website was being upgraded, but that is not captured on my u-filing profile.

I have already lost two days trying to get hold of the call center, sent numerous emails to all the listed support addresses, all returned..

No call agents answering.

Maternity

Good day I've been struggling to get my Maternity pay out for 3 months now I submitted everything on the 4th of February and l was told to wait for 35days and I'll get the money 35 days went by I went back and they told me that the scanner didn't scan all my documents through and they scanned everything through again well we on the 23rd of April and I'm still waiting and no can give me answers please help!!!!!!!!!!!!!!!

OUR COMPANY PHODI CLINICS DEDUCT UIF FROM OUR SALERY AND DO NOT PAY IT OVER TO YOU.

UIF PAYMENT

My mum is 78 year old that lost her job she been retrenched end December 2018 we been at UIF office Kempton Park to apply for UIF. We got a message that her application was rejected we took her back she was told everything is in order. Took her back 5 times last 2 times was told she will get her money in 7 days. Phoned the call centre to follow up was told her application still isn't approved. My mum is 78 and earns no income at all she needs this money urgently to live. Please how can he get this sorted?
